PROMOTER

  1. The Promoter is Travel Insurance Direct Pty Limited ABN 30 121 659 470 AR 305589, Level 18, 1 Farrer Place, Sydney, New South Wales, 2000 Australia (1300 410 272) (“Promoter”). 
COMPETITION PERIOD
  1. The competition starts at 12:01am AEST 1 July 2023 and ends at 11:59pm AEST, 14 August 2023 (“Competition Period”). All references to time are local in Sydney, Australia. All entries must be received during the Competition Period and meet other requirements in these Terms and Conditions to be eligible to win the Prize.

WHO MAY ENTER

  1. This competition is open to all Australian residents, who complete the competition entry form on the TID website, which will subscribe them to the TID newsletter, and who submit a response to: Tell us about the most fun holiday you've ever had in 25 words or less. An entrant must be an individual and not a company or organisation. Employees, immediate family members and/or household members of the promoter or its related bodies corporate are ineligible to enter the competition.

ENTRANTS BOUND BY CONDITIONS

  1. By participating, entrants agree to be bound by these Terms and Conditions. The promoter reserves the right not to award the Prize if the entrant fails to meet these terms.

HOW TO ENTER

  1. To enter, entrants must read these Terms and Conditions and complete each of the following during the Competition Period:
a. Visit the Competition entry page at www.travelinsurancedirect.com.au/theiconic-competition, agree to these Terms and Conditions and follow the instructions to submit (“Submission”):
i. Your personal details (first name and email) in the submission form fields
ii. Tell us about your most fun holiday in 25 words or less
b. Subscribe to the TID newsletter

Entries must be:

a. the original independent creation of the entrant;
b. the personal experience of the entrant;
c. owned by the entrant;
d. 25 words or less;
e. in English; and
f. free of any claims, including copyright or trademark claims, by other parties.

  1. Entries must not:
a. have been published previously;
b. have won prizes or awards in other competitions;
c. be restricted in any way;
d. infringe on any third party rights, including but not limited to, copyrights, trademark rights, or rights of privacy and publicity;
e. contain disparaging or defamatory statements;
f. include threats to any person, place, business or group;
g. be obscene, offensive, or indecent;
h. depict risky or illegal behaviour, actions or intent;
i. contain material that promotes bigotry, racism, hatred or harm, against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.

LIMITATIONS ON ENTRY

  1. Only one entry per person will be accepted. Entries submitted after 12:00am AEST 15 August 2023 will not be accepted.
  1. Entry into the competition is free. However, any costs associated with an individual entering the competition including postage fees or any fees associated with uploading content is the responsibility of the entrant.

ENTRY VERIFICATION

  1. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions.

SELECTION OF WINNERS

  1. Between 15 August 2023 and 31 August 2023, a panel of judges (selected by the Promoter) will rate the eligible Submissions in Sydney, New South Wales based on originality (50%) and creativity (50%) (“Judging Criteria”). Chance plays no part in determining the winner. The judges’ decision is final and no correspondence will be entered into. The entry deemed to be the most original and creative will be awarded the Prize listed in Clause 11.

  1. There are three prizes to be won. Each prize consists of a $500 AUD eGift Card to be used at select brands.

WINNER NOTIFICATION AND PUBLICATION

  1. The winner will be notified in writing via email within four (4) days of the judges’ decision and their name may be published on www.travelinsurancedirect.com.au/theiconic-competition within four (4) days of the judges’ decision, for a minimum period of 28 days. If the email is returned undeliverable or no response is received within four (4) days, the competition will be rejudged and another winner identified. No responsibility will be accepted for emails which are misdirected or end up in the spam folder. The Promoter may not notify entrants of failure to win a Prize. The Promoter will make reasonable efforts to contact the Prize winners, however the Promoter is not responsible for contacting the winners by any other method, or for the winner not receiving notification for any reason. Entrants are responsible for providing and maintaining correct contact details. Each entrant warrants that any details provided with his/her entry are true and accurate, and the entrant indemnifies the Promoter against any loss or damage resulting from any breach of this warranty.
  1. The Promoter is not responsible for any lost, late, incorrectly entered or misdirected entries.
  1. The Promoter is not responsible for any problems, technical malfunction or failure of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email or other communication network or system, including any failure of an entry to be received in whole or in part by the Promoter due to any of the above or on account of other technical problems or traffic congestion on the internet or at any website or telecommunication systems, or any combination of these issues.

PRIZE DELIVERY

  1. The Promoter will deliver the Prize by email to the winner’s email address within 10 days of the winner’s email reply to the notification of their win. If the email is returned undeliverable or no response is received within 48 hours, the competition will be rejudged and another winner identified. No responsibility will be accepted for emails which are misdirected or end up in the spam folder.
  1. The Promoter will not replace any lost or stolen Prize component once it has been emailed to the winner’s email address.

LIABILITY

  1. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking the Prize, except for any liability which cannot be excluded by law.

CONSENT TO USE ENTRIES

  1. By entering the competition, entrants consent to the information they submit with their entry, including personal details and/or literary response, being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity purposes (including sending electronic communication) without any further reference, payment or other compensation to the entrant. The Promoter will have no obligation to publish or use or retain any Submission you submit or return any such Submission to you. You agree that it is your sole responsibility to obtain all permissions and releases necessary for the grant of the rights contained in this paragraph and these Terms and Conditions.
  1. All entries are the property of the Promoter.
  1. The Promoter can use user-generated content that we will credit to the contributor.

PRIVACY

GENERAL TERMS AND CONDITIONS

  1. The Competition and these Terms and Conditions will be governed, construed and interpreted under the laws of New South Wales, Australia.
  1. If any provision of these Terms and Conditions is deemed unenforceable, they will be enforced to the extent permissible and the remainder of these Terms and Conditions will remain in effect.
  1. The Promoter reserves the right to amend these Terms and Conditions or to terminate this Competition at any time. Entrants who violate these Terms and Conditions, violate any law, rule or regulation in connection with participation in the Competition, tamper with the operation of the Competition or engage in any conduct that is detrimental or unfair to the Promoter, the Competition or any other entrant (in each case as determined in the Promoter’s sole discretion) are subject to disqualification from entry into the Competition
